When you apply for insurance or any service through The Climate Corporation or its affiliates or subsidiaries, contact us by telephone, or contact us directly through The Climate Corporation Service Platform, we may collect information about you to assist us in providing insurance coverage and other web-based tools and services, supplying product information, servicing your policy or responding to your customer requests. We may also collect information when we contact you by phone, e-mail or mail. The information collected may include nonpublic personal information, such as: 

 

    • Information about your transactions with us or others relating to insurance coverage, farming practices and/or agricultural operations
    • Information used to underwrite or establish your eligibility for  products or services offered by The Climate Corporation, its affiliates or subsidiaries
    • Information relating to the processing or administering of your customer account, policy, coverage or claims.
    • Credit or consumer reporting information or history used in the process of processing an application for insurance, servicing or collecting payment on an account
    • Payment information, such as credit card or other financial account information used as a means of payment to or from The Climate Corporation, its affiliates or subsidiaries.


Information We May Provide to Others


We may disclose nonpublic, personal information about our applicants, customers, and former customers as permitted by law or required by law, and in performing our normal insurance operations.  To the extent necessary to perform our insurance obligations, or as required by regulation, court order or law, we may also share information with other companies that are involved in issuing or administering our insurance program, such as your agent, the issuing insurer on your policy, our financial service providers, legal counsel, claims investigation service partners or fraud prevention service providers. Examples of when we may use your information include:

 

  • When performing normal service operations when issuing your policy or handling your claim
  • When our customer support operations engage to review or respond to a customer inquiry
  • When our legal support team handles a legal dispute or is required to provide information in the course of litigation
  • When we are required to provide information to a government agency in response to an audit, exam, inquiry or data request


Use of Information


By giving us your telephone number, you consent to being contacted by that number, including if that number is for a cell phone or other wireless device. We may contact you in person, by recorded message, by text message or by other means of communication your device is capable of receiving, as allowed by law and for reasonable business purposes, including informing you about marketing promotions, collecting information on product improvements, and to service your policy with us. The website www.climate.com and related websites and services that make up The Climate Corporation Service Platform are owned and operated by The Climate Corporation. The Climate Corporation values the privacy of users of The Climate Corporation Service Platform (collectively or individually "Users"). This section specifically addresses the information you provide to us or that we learn from your use of The Climate Corporation Service Platform and tells you how we may collect, use, and in some instances share this information

The Climate Corporation uses automatically collected information and cookies information to: (a) remember your information so that you will not have to re-enter it during your visit or the next time you visit The Climate Corporation Service Platform; (b) provide custom, personalized advertisements, content, and information; (c) monitor the effectiveness of our marketing campaigns; and (d) monitor aggregate usage metrics such as total number of visitors and pages viewed.

 

The Climate Corporation may disclose both personally identifiable and automatically collected information to affiliated companies or other businesses or persons to process such information on our behalf, to provide website maintenance and security, to offer certain features on the The Climate Corporation Service Platform, to assist us in improving the way The Climate Corporation Service Platform works and looks, and to create new features. Website & Data Security


Account Information
If you hold a customer, user or agent account, you may have access to personal information for yourself or your clients, and you may be able to update, correct, or delete your or your client’s member information and email subscription preferences at any time. To protect your privacy and security, we take reasonable steps to verify your identity before granting User’s member profile access. You are responsible for maintaining the secrecy of your unique password and account information at all times AND FOR ANY TRANSACTIONS PERFORMED FROM THAT ACCOUNT.

Third-party Advertisers
The Climate Corporation may allow other companies, called third-party ad servers or ad networks, to serve advertisements within The Climate Corporation Service Platform. These third-party ad servers or ad networks use technology to send, directly to your browser, the advertisements and links that appear on the Climate Corporation Service Platform. They automatically receive your IP Address when this happens. They may also use other technologies (such as cookies, JavaScript, or web beacons) to measure the effectiveness of their advertisements and to personalize their advertising content.

The Climate Corporation does not provide any personally identifiable information to these third-party ad servers or ad networks without your consent or except as part of a specific program or feature for which you will have the ability to opt-in. However, please note that if an advertiser asks The Climate Corporation to show an advertisement to a certain audience or audience segment and you respond to that advertisement, the advertiser or ad-server may conclude that you fit the description of the audience they were trying to reach.

You should consult the respective privacy policies of these third-party ad servers or ad networks. The Climate Corporation’s Privacy Policy does not apply to, and we cannot control the activities of, such other advertisers or websites.

Data Transmissions
No data transmissions over the Internet can be guaranteed to be 100% secure. Consequently, we cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk. Please note that email messages are not secure.  Our security programs do not encrypt email messages. However, once we receive your transmission, we make reasonable efforts to ensure security on our systems through procedural, manual and electronic security controls which include identifying the information that should be protected and providing adequate levels of protection for those pieces of information. We use secure server software (SSL) and firewalls to protect your information from unauthorized access, disclosure, alteration, or destruction. While this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of such firewalls and secure server software, we are committed to keeping our customer’s information secure and to maintaining compliance with all relevant state and federal requirements concerning information security.

If The Climate Corporation learns of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. By using The Climate Corporation Service Platform or providing personal information to us you agree that we can communicate with you electronically regarding security, privacy, and administrative issues relating to your use of The Climate Corporation Service Platform. The Climate Corporation may post a notice on The Climate Corporation Service Platform if a security breach occurs. If this happens, you will need a web browser enabling you to view The Climate Corporation’s Service Platform. The Climate Corporation may also send an email to you at the email address you have provided to us in these circumstances. The Climate Corporation Service Platform is hosted in the United States. If you are a User accessing The Climate Corporation Service Platform from the European Union, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure, that differ from United States laws, please note that you are transferring your personal data to the United States which does not have the same data protection laws as the EU and other regions, and by providing your personal data you consent to:

1. the collection, use, and disclosure of your personal data for the uses identified above in accordance with the Privacy Policy; and

2. the transfer of your personal data to the United States as indicated above.
